On August 15, 2008, the parties to the lawsuit reached a settlement of this action, whereby Defendants agreed to pay $14.3 million to class members. The Court has scheduled a hearing on December 15, 2008 at 10:00 a.m. at the New Castle Courthouse, 500 King Street, Wilmington, DE 19801, before Vice Chancellor Stephen P. Lamb, to determine whether to approve the settlement as fair, reasonable, adequate, and in the best interests of class members.
