Lawrence P. Kolker, a partner of the firm, has acted as lead counsel in numerous class and derivative actions asserting the rights of investors. He also counsels investment management firms in transactional and securities matters and represents them in corporate and business litigation.
Mr. Kolker has often represented investors in direct investments, such as REITs and limited partnerships. His cases have concerned Inland Western REIT, Wells REIT, CNL Hotels & Resorts, Inc., Insignia (DeForest Tender Offer), General Electric (Polaris Aircraft limited partnerships), Cencom Cable TV, Jones Intercable, Nooney and Sierra Pacific (American Spectrum roll-up), Real Estate Associates (NAPICO roll-up), McNeil Real Estate, Realmark Property Investors, Damson Birtcher Real Estate Associates, Marriott Hotel Properties II, Atlanta Marriott and Southeast Hotel Properties LP.
He was appointed Counsel to the Courtyard by Marriott Limited Partners Committee in its dealings with Host Marriott Corporation, and Special Counsel to the Windsor Park Properties 7 and 8 limited partners to insure the fairness of their liquidation transactions.
He was a member of the trial team in Robbins v. Koger Properties, a securities fraud action in which the plaintiff class obtained an $81.3 million dollar jury verdict, and County of Suffolk v. Long Island Lighting Co., in which the plaintiff obtained a $22.9 million verdict under the RICO Act. His notable judicial decisions include Stepak v. Addison, 20 F.3d 398 (11th Cir. 1994); In re Comdisco Securities Litigation, 2003 U.S. Dist. LEXIS 5097 (N.D. Ill. March 3, 2003); City Partnership Co. v. Cable TV Fund 14-B, 213 F.R.D. 576 (D. Colo. 2002); Sturm v. Marriott Marquis Corp., 85 F. Supp. 2d 1356 (N.D. Ga. 2000); In re Southeast Hotel Properties Limited Partnership Investor Litigation, 151 F.R.D. 597 (W.D.N.C. 1993); Prostic v. Xerox Corp., [1991 Transfer Binder] Fed. Sec. L. Rep. (CCH) ΒΆ 96,1967 (D. Conn. July 19, 1991); In re Cencom Cable Income Partners, L.P. Litigation, Consolidated C.A. No. 14634, 2000 Del. Ch. LEXIS 10 (Jan. 27, 2000); and Wallace v. Wood, 752 A.2d 1175 (Del. Ch. 1999).
Mr. Kolker, a frequent speaker at conferences of the Investment Program Association and the Strategic Research Institute concerning tender offers and litigation strategies, has also published articles in Standard & Poor's Review of Securities and Commodities Regulation.
A member of the New York State Bar Association, he is also a member of the Bar of the United States Courts of Appeals for the Second and Eleventh Circuits and the United States District Courts for the Southern and Eastern Districts of New York, the District of Colorado and the Western District of Michigan.
Mr. Kolker was an Assistant Corporation Counsel of the City of New York from 1983 to 1987, a lecturer at Brooklyn Law School in 1989 and on the Panel of Early Neutral Evaluators for the Eastern District of New York from 1993 through 1997. He has served as a judge in moot court competitions at New York University Law School and Brooklyn Law School.
A graduate of Binghamton University in 1978, Mr. Kolker obtained his J.D. at Brooklyn Law School in 1983, where he was the Business Editor of the Brooklyn Law Review.
He is an accomplished singer-songwriter with a CD entitled "Long Island Slim."
